| Building restrictions and easements contained in land transfer deed to (1) limit the depth any building erected at 172 Commonwealth to no more than 88 feet, except for a rear bay window or octagon front of the same dimension permitted under the stipulations continued in the deed from the Commonwealth, and extending no more than 5 feet from the rear face; (2) limit the height of any building at 172 Commonwealth to no more than the 3 feet above the height of the building at 176 Commonwealth (with exceptions for fire walls and chimneys); and (3) establish an easement for light and air over the 13.5 foot strip between the western wall of the Hotel Vendome and 172 Commonwealth. The owner of the Hotel Vendome reserves the right to build on the 13.5 foot strip and, if he does, both the easement and the building restrictions terminate. The owner of the Hotel Vendome also reserves the right to maintain the Hotel Vendome “as now built.” | ||||
