Building restrictions included in land transfer deed for the benefit of 308 Commonwealth specifying that (1) no building shall be erected at 306 Commonwealth the main part of which extends further south from Commonwealth Avenue than the following lines: from a point on the western boundary 64 feet 4 inches south of Commonwealth, running southeast at an angle of 45 degrees until intersection with a second line extending west from a point on the eastern boundary of the premises by a line parallel to and 64 feet south of Commonwealth, except that (a) the basement may extend one foot further, and (b) an ell may be constructed on the eastern boundary, being no more than three stories and extending no further than 92 feet from Commonwealth and not more than 12 feet 4 feet from the eastern boundary (but allowing a bay to extend on the rear of the ell one foot); (2) 308 Commonwealth reserves the right to maintain windows in the party wall, subject to the grantees right “to build against and close up any of said windows and restore the party wall the same may become necessary in the erection of any building upon the granted premises or of any addition thereto.”
