Agreement that, inasmuch as the new drainage contemplated in the agreement on March 8, 1888, has not been built and the previous drainage system is continuing to be used, the use of the existing drainage does not constitute an easement over the properties at 45-51 Hereford, and the 1888 agreement remains in effect with the costs of the new drainage to be shared if and when it is built.
