Transfer of a plot of land on Marlborough Street subject to provisions that (1) the land “shall be used only as an open grass plot and for placing and maintaining thereon the statue of John Winthrop, recently standing in Scollay Square;” and (2) “any time the said First Church in Boston or its successors shall cease to use for a church its property adjoining the premises hereby conveyed, either because of sale of its church building on said property to others for a church or for any other reason, and shall cause to be recorded in the Suffolk Registry of Deeds a declaration that this grant is terminated, or if at any time the said statue shall be removed from said premises this conveyance shall thereupon become void, the premises hereby conveyed shall revert to the grantor herein named and its successors and in case the said statue has not been removed, the City shall forthwith remove it from the said premises.”
